Federal Court Vacates Pentagon Supply Chain Risk Designation of Anthropic
U.S. District Judge Rita Lin of the Northern District of California ruled that the Trump Administration unlawfully designated Anthropic as a federal supply chain risk and imposed government-wide restrictions on the company. The dispute arose after negotiations over military use of Anthropic’s Claude models broke down when Anthropic sought restrictions on uses including autonomous weapons and mass domestic surveillance. Judge Lin found that the designation constituted unlawful retaliation in violation of the First Amendment, deprived Anthropic of required due process under the Fifth Amendment and violated the governing statutory framework. The court also concluded that portions of the government’s actions were arbitrary and capricious and vacated the challenged designation. Anthropic’s separate challenge in Washington, D.C. remains pending. Judge Lin’s ruling places a significant limit on the federal government’s ability to use procurement and supply chain authorities to penalize domestic technology providers over disagreements concerning acceptable uses of their products. It also highlights the growing tension between government demands for broad operational control over advanced AI systems and developers’ efforts to maintain contractual and technical restrictions on high-risk applications.
